
Conditions of Use (2022)

1. If reservation has been made using an Online Travel Agent (OTA) these Conditions of Use will run in conjunction with those in place with the OTA they do not replace those of the OTA. If the Conditions of Use are breached, the OTA will be asked to negotiate and deal with the claim submitted by either the Owners or Clients.
​
2. On arrival, you will be asked to complete an occupancy form. To read and sign your acceptance of the Conditions of Use and to supply a deposit if not already made or received.
​
3. The property known as Le Guet du Garde (“the Property”) is offered for holiday rental subject to confirmation by Sally Smith (“the Owners”) or the Online Travel Agent (“OTA”) to the renter/hirer (“the Client”).
​
​​4. If payment is not received by the due date, the Owners reserve the right to cancel the booking. (Any additional chargeable expenses during the rental period should be settled locally with the Owners prior to departure.)
​
​5. Cancellation will be governed by the OTA utilised to book the Property. If booking directly with Le Guet du Garde the following conditions apply: cancelations must be received 5 days before arrival for a full refund. (We ask you to remember this is an important income for the Owner and last-minute cancelations without time for another person to book is a loss of income.)
​
5.1 If the French government or the government of the country where the Client resides closes their borders and/or travel is not permitted, cancelations can be made up to the day before arrival and a full refund will be given.
​
5.2 Any cancellation by the Client must be made formally in writing except in the case of non-payment of the total rental cost by the due date, which will be taken as a formal notice of cancellation by the Client and written notice will not be required.
​
5.3 In the unlikely event that the Owners are forced to cancel your booking due to serious sickness or there are major factors beyond the Owner’s control, the Owners will advise the Client as soon as possible and the Owners will give the Client a complete refund of all monies paid by the Client and the Owners will have no further liability.
​
5.4 Cancellation is valid only upon written acknowledgement by the Owners.
​
6.The Client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party’s personal belongings, public liability etc., since these are not covered by the Owners insurance.
​
7. A security deposit of €200 - is required in case of damage to the property or of its contents, excessive use of electricity (point 19), additional cleaning charge (point 10.1) or IT support charge (point 23.2). However, the sum reserved by this clause shall not limit the Client’s liability to the Owners.
​
7.1 The security deposit held by the Owners or OTA will be applied against repair or replacement caused by means other than usual wear and tear during the rental period.
7.2 Pending a satisfactory inspection, the security deposit / bank / credit card authorisation will be released after the keys have been returned and the premises have been checked within the parameters stipulated by the OTA or no later than 14 days after departure.

7.3 If charges are required, this will be agreed via email/phone and method of payment will be agreed.
​
​8. The rental period shall commence at a time agreed between the client and the owners which is usually at 4.00 pm on the first day and finishes at 10.00 am on the last day.
​
8.1 The Owners shall not be obliged to offer accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated (unless agreed in writing with the owners).
​
8.2 If the rental period is to be shortened by the Client for any reason, the rental fee will not be changed and there will be no refund.
​
​9. The maximum number to reside in the Property is 2 persons and this include adults and/or children, babies in cots not included in this head-count. Facilities open only to residential guests listed on the Occupancy form. Please seek prior approval from Owners should you expect additional or external guests, this will not be unduly withheld.
​
​10. The Client is responsible for all members of their guests and party residing and/or using the facilities of the Property. The Client agrees to be a considerate tenant and to take good care of the Property and to leave it in the same condition as they received it at the end of the rental period.
​
10.1 All the accommodation is cleaned to Covid-19 regulations and checked before any Client’s arrival and we do expect the Client to leave the property as found. The Owners also reserve the right to make retention from the Security Deposit, to cover additional cleaning or repair costs if the Client leaves the Property in an unacceptable condition or damage is discovered.

10.2 The Client agrees not to act in a way, which would cause disturbance to neighbouring properties as the Property is situated in a peaceful and tranquil neighbourhood. Any Client or their guests deemed to be acting in a consistently unreasonable manner will be asked to leave the Property.
​
​11. The Client shall report to the Owners, without delay, any defects in the property, or breakdown in the equipment or appliances in the Property or garden and arrangements for repair and/or replacement will be made as soon as possible. (A charge is not always levied, but the Owners would rather be notified than to find out for themselves after the Client’s departure.) The Client undertakes to allow maintenance personnel, cleaning staff and the Owners reasonable access to the Property rented for the purpose of repair and maintenance.

11.1 Complaints cannot be accepted upon or after the Client’s departure.
​
​12. The Client and their guests/party use the facilities provided at the Property including all of its surrounding area entirely at their own risk and the Owners shall not be responsible for any loss, damage, injury or death.
​
​13. Use of the accommodation and all amenities is entirely at the Client’s own risk. Client’s personal belongings (including motor vehicles) left in or around the Property are entirely at Client’s own risk, and no responsibility will be accepted for loss or damage thereto.
​
​14. Linen for 2 persons will be provided during the rental period (a supplementary charge will be imposed for additional requests). Neither linen nor fixtures and furnishings from the Property are to be taken off the property. Following our inventory, any shortfall of linen/towels, etc… following client’s departure will be invoiced accordingly. For hygiene and the environment, we ask that you remove the used bed linen, towels and dish cloths and place them in the laundry bags provided, we however ask that you DO NOT put them onto wash.

14.1 A detailed inventory is available for your review and it is suggested you check anything you are unsure of against the details of this list. We however, do not expect you to count every plate and glass in the property. Accidental damage is to be expected. However, the complete loss of, for example, the dinner service will be treated as theft or malicious damage. If you are uncertain of anything on the inventory, please bring it to the Owners attentions immediately during your stay.

​​​15. Smoking is not permitted within any rooms of the Property, please dispose of cigarette ends outside in a clean and responsible manner.
​
​16. One house trained dog is welcome free of charge. A bin and appropriate bags are provided for you to clean up after your dog in the garden. Dogs are not allowed onto armchairs unless you have completely covered them (throws are provided). Please be mindful of the next visitor who may not have dogs and of the cleaners who have to clean up after they have shed fur or left muddy paws over the soft furnishings.

​17. Dog Care is offered at an additional cost and should be booked as soon as possible to ensure the owner is available to offer the service on that day.
​
​18. Electricity. A meter reading is taken the day of your arrival, and again the morning of your departure. Usage above the amounts stipulated below will be charged at the current rate paid by the owner and will be verified by sight of a recent utilities bill.
​
18.1. Summer lettings electricity usage (consumption) are calculated at a usage of 5 kwt of electricity per 24 hours.
​
18.2. Winter letting electricity usage (consumption) are calculated at 40 kwt of electric per 24 hours. In addition, the Owners will supply enough wood to run the wood burner for the length of the stay, (additional wood can be purchased from the Owners if required).
​
18.3 Electric cars - Fast charging is available in the car park opposite the garage.
​
19. The Property is on mains drainage however. Please do not flush any dry goods e.g. coffee grounds, sanitary napkins, tampons, baby’s nappies/wipes or thick wads of toilet papers down the drains or toilets. Also French drainage cannot handle British toilet paper, which is thicker than the French equivalent, so only paper purchased in France is to be used.

​20. The Client and their guests/party at the Property must not do anything or permit anything to be done that would or may result in the insurance of the Property becoming void or voidable or the premium being increased. The right to use the Property may be revoked with immediate effect by the Owners before the end of the rental period by the Owners giving the Client notice in the event of the Client being in serious breach of this agreement.

​21. The Owners shall not be liable to the Client for:
​
21.1 Any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery, appliance in the property or garden.
​
21.2 Any loss, damage, injury or death that is the result of adverse weather conditions, riot, strikes, war or other matters that are beyond the control of the Owners.
​
21.3 Any loss, damage or inconvenience caused or suffered by the Client if the Property shall be destroyed or substantially damaged before the start of the rental period. In any such event, the Owners shall refund, within two working weeks of notification to the Client, all sums previously paid to the Owners for the rental period. In the event of the booking being cancelled or altered by reason of force majeure (which includes floods, storms, riots, strikes, wars, and Acts of God) or other events outside the Owners’ control, the Owners cannot accept any liability.

​22. Computers, Servers, Routers, VOIP, Wireless, Electronic equipment:
​
22.1 Wi-Fi is provided free of charge and very occasionally the connection from the provider is down. This is beyond the Owner’s control. The Owners cannot accept any responsibility for loss or lack of a stable internet connection. Wi-Fi coverage extend within the confines of the house.
22.2 The IT equipment in the Property must not be altered, adjusted or interfered with in any way and if any of the computer hardware is found to have been tampered with causing a malfunction or interruption to the system or internet services the Security Deposit will be used to cover the cost of the IT support fee to reset the system.

​23. Modifications. The owner reserves the right to amend these Conditions of Use from time to time. Modifications of a substantive element after the date of booking which the Client believed to change their stay requirements will be just cause for the Client to terminate his or her contract and receive, without deduction, an immediate refund of all sums paid.
​23.1. The Owners reserve the right to make changes to the interior and/or exterior of the venue between the time we accept your booking and the date of your rental. For example, the Owners may make changes to the décor and colour schemes of our rooms, and the Owners cannot guarantee that the venue and its surrounds will be free from additional or removal of structures or planting (such as pergola or trees).

23.2 Owners reserve the right to make changes to certain components if this is necessary to comply with safety requirements or other changes in law or relevant codes of practice, or to make other minor changes which we believe will not be to the detriment of your overall holiday experience and which will not increase the price.
​
​24. From time to time the Owners would like to publish the Client’s comments on their websites and advertisement, so unless otherwise requested, the Owners will assume that the Client has no objection.
​
​25. Under no circumstances shall the Owner’s liability to the Client exceed the amount paid for the rental period.
​
​26. Whilst every effort has been made to ensure that the description of the Property and nearby facilities are as accurate as possible, the Owners cannot accept any liabilities for any changes beyond the Owners’ control.
